Terms of Service
These Terms of Service (“Terms”) govern your use of The Resilience Matrix (“the Service”, “the Tool”), operated by The Resilience Matrix (“we”, “us”, “our”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description
The Resilience Matrix is an AI-powered career resilience analysis tool. It evaluates job descriptions using a three-filter ensemble methodology based on six peer-reviewed academic frameworks to produce a resilience score (0–100) and task-level breakdown.
The Service is provided on an “as-is” basis for informational and strategic planning purposes only.
2. Eligibility
You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you meet this requirement.
3. Acceptable Use
You agree to use the Service only for lawful purposes. You may not:
- • Submit content that is illegal, defamatory, or infringes on the rights of others
- • Attempt to extract, reverse-engineer, or reconstruct the scoring engine, system prompts, or calibration data
- • Use automated tools (bots, scrapers) to access the Service in bulk without prior written consent
- • Attempt to circumvent rate limits, registration gates, or security measures
- • Inject adversarial prompts or otherwise attempt to manipulate the analysis engine
- • Resell, redistribute, or commercially exploit the analysis output without prior written consent
- • Misrepresent analysis results as a guarantee of employment outcomes
4. Intellectual Property
4.1 Our IP
The Resilience Matrix methodology, scoring engine, calibration data, system prompts, user interface, brand identity, and all associated documentation are the proprietary intellectual property of The Resilience Matrix, protected by:
- • Copyright under the Copyright Act 98 of 1978 (South Africa) and the Berne Convention
- • Trade secret protection under South African common law (the calibration anchors, system prompts, and ensemble configuration are confidential)
- • Database rights in the compiled analysis data under applicable law
Unauthorised reproduction, distribution, or derivative use of our methodology, scoring system, or calibration data is prohibited. The publication of our scoring formula and framework references on the methodology page does not constitute a waiver of intellectual property rights in the proprietary implementation.
4.2 Your Content
You retain all rights to job descriptions and other content you submit. By submitting content, you grant us a limited, non-exclusive licence to:
- • Process the content through our analysis engine to provide results
- • Store the content for service improvement and aggregate trend analysis
- • Use anonymised, aggregate data derived from analyses for research purposes
We will not publish, share, or sell your individual job descriptions to third parties.
5. Disclaimer of Warranties
Important
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Specifically, we do not warrant that:
- • Resilience scores are a prediction of actual job displacement or employment outcomes
- • The analysis is free from errors, biases, or inaccuracies inherent in the underlying AI model
- • The Service will be available without interruption
- • The frameworks and scoring weights will remain static (they are updated as new research emerges)
The Resilience Matrix is a strategic planning instrument, not an employment guarantee, legal opinion, or financial advice. Decisions made based on the analysis are solely your responsibility.
6. Limitation of Liability
To the maximum extent permitted by South African law, The Resilience Matrix shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to:
- • Career decisions made based on resilience scores
- • Loss of employment or business opportunities
- • Organisational restructuring decisions informed by analysis results
- • Data loss or service interruptions
Our total aggregate liability for any claims arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim (for free-tier users, this is zero).
7. Free Tier & Premium Services
The Service currently offers a free tier with a limited number of analyses. We reserve the right to:
- • Change the number of free analyses available
- • Introduce premium (paid) features with separate terms
- • Modify or discontinue any feature of the Service with reasonable notice
Joining the premium waitlist does not create a contractual obligation on our part to deliver any specific feature or service.
8. Data Processing & Privacy
Your use of the Service is also governed by our Privacy Policy, which details how we collect, use, and protect your personal information in compliance with the Protection of Personal Information Act 4 of 2013 (POPIA).
By submitting a job description for analysis, you consent to:
- • The transmission of your input to third-party AI inference providers (currently Groq Inc.) for processing
- • The storage of analysis results in our database for service improvement
- • The use of anonymised, aggregate data for AI adoption trend research
9. Electronic Communications (ECTA)

10. Indemnity
You agree to indemnify, defend, and hold harmless The Resilience Matrix from any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from:
- • Your use of the Service in violation of these Terms
- • Your submission of content that infringes on the rights of third parties
- • Any misrepresentation of analysis results to third parties
11. Termination
We reserve the right to suspend or terminate your access to the Service at any time, without notice, for conduct that we determine, in our sole discretion, violates these Terms or is harmful to the Service, other users, or third parties.
Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including IP, disclaimers, liability limitations, and governing law) shall survive.
12. Modifications to Terms
We may modify these Terms at any time by posting the revised version on this page with an updated “Last updated” date. Material changes will be highlighted. Your continued use of the Service after modifications constitutes acceptance of the revised Terms.
13. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to conflict of law principles.
Any dispute arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.
Applicable legislation includes but is not limited to:
- • Protection of Personal Information Act 4 of 2013 (POPIA)
- • Electronic Communications and Transactions Act 25 of 2002 (ECTA)
- • Consumer Protection Act 68 of 2008 (CPA)
- • Copyright Act 98 of 1978
14. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
